Biography
Kelly is dedicated to resolving matters for her clients, even when the odds are stacked against them. In 2014, Kelly second-chaired a two-week jury trial in which she defended the interests of a masonry contractor in a breach of implied warranty of habitability construction defect claim. Plaintiff, a condominium association, claimed it sustained water intrusion in its multi-unit mixed use condominium as a result of the mason’s poor construction, and requested the jury award the association $3,000,000 in damages, the largest request in an Illinois implied warranty of habitability jury trial recorded in Illinois based upon available jury verdict records. After only a forty-five minute deliberation, the jury returned a verdict in favor of her client.
As a member of SmithAmundsen's Construction and Commercial Litigation Practice Groups, Kelly zealously advocates for her clients in personal injury claims, construction defect claims, property damage claims, OSHA citations and issues, and breach of contract issues. She is fluent in all means of dispute resolution, including early settlement negotiations, dispositive motions, mediations, binding arbitrations, and both jury and bench trials.
