Biography
Edward Mullins is a senior associate in the firm’s Parsippany office. His practice focuses on commercial litigation, consumer class action defense, and law enforcement investigations involving consumer protection and data privacy. Mr. Mullins represents clients in nationwide consumer fraud disputes across numerous consumer products industries, including food & beverage, insurance, retail, and telecommunications. Mr. Mullins previously was a Deputy Attorney General with the Government & Healthcare Fraud Section in the Division of Law, Office of the Attorney General of New Jersey. He prosecuted several high-profile civil enforcement actions on behalf of State agencies, consumers, and investors for violations of the New Jersey Consumer Fraud Act (CFA) and the New Jersey False Claims Act (NJFCA), and related state and federal laws, in state and federal courts.
New Jersey Attorney General Experience
Mr. Mullins was lead counsel against a financial services company for CFA violations in a parallel, multi-state action alongside nineteen other States and the Department of Justice (DOJ). He navigated the case’s removal and transfer to the Judicial Panel on Multidistrict Litigation and an MDL proceeding in Manhattan federal court. After remand, he successfully argued and defeated the motion to dismiss, and helped New Jersey achieve its share of the billion-dollar, global settlement.
Mr. Mullins was co-counsel against companies that failed to collect or secure digital data or personally identifiable information (PII) pursuant to the CFA, as well as the Computer Related Offenses Act (CROA), the Children’s Online Privacy Protection Act (COPPA), and the Health Information Technology for Economic and Clinical Health Act (HITECH). As part of this effort, he obtained injunctions and million-dollar consent judgments involving on-line advertising, Bitcoin mining, and gaming companies. He also participated on the executive committees of lead States investigating some of the largest retail data breaches ever, affecting hundreds of millions of consumers, and partnered with the New Jersey State Police and the Federal Trade Commission (FTC).
Mr. Mullins was lead or co-counsel in a dozen whistleblower or qui tam matters against government contractors or other recipients of State funding for violations of the NJFCA relating to fraudulent healthcare, higher education, and other services.
Mr. Mullins began his career in private practice working on litigation matters involving consumer fraud, consumer lending, consumer privacy, products liability, healthcare fraud, patent infringement, and shareholder disputes.
Representative Experience
Defending clients in putative class actions alleging claims under the Telephone Consumer Protection Act (TCPA) for unsolicited telemarketing calls, calls to cellular telephones, spam text messages or unsolicited facsimiles (“junk fax”).
Representing clients investigated by the Federal Communications Commission (FCC), FTC, and State Attorneys General relating to consumer advertising and transactions.
Mediated commercial contract disputes on behalf of a national wireless carrier and a health information technology company.
Advised online retailer about class action liability under New Jersey’s Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA).
Member of the litigation team that represented banks in contested commercial and residential foreclosure actions throughout New Jersey. Achieved dismissal and summary judgment.
Successful defense of consumer reporting agency from an application for temporary restraining order (TRO) in connection with information services contract dispute regarding Fair Credit Reporting Act (FCRA) compliance and binding arbitration.
Part of the litigation team that defended aviation, heavy equipment, and consumer goods manufacturers and common carriers in connection with products liability and negligence suits across the country. Obtained dismissals on summary judgment and favorable settlements.
Represented a pharmacy benefit manager executive against federal anti-kickback accusations.
Defended an international pharmaceutical company against common law fraud actions in multiple states relating to Average Wholesale Price (AWP).
