What rights does a tenant have?

  1. AZ Residential LL/T Act - ARS Title 33, Chapter 10

    By statute, LLs in AZ have to maintain a property to certain standards:
    Section 33-1324(A)(2) of the Arizona Revised Statutes mandates that a landlord, “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition.”
    Section 33-1324(A)(3) of the Arizona Revised Statutes mandates that a landlord, “keep all common areas of the premises in a clean and safe condition.”
    Section 33-1324(A)(4) of the Arizona Revised Statutes mandates that a landlord, “maintain in good and safe working order and condition all ventilating, air-conditioning and other facilities, supplied or required to be supplied by [Landlord].”
  2. Has the LL Breached?

    If so, pursuant to A.R.S. §33-1361(A), a proper WRITTEN notice will need to be sent to the LL to in order to begin the time clock for repairs to be made.

If the repairs are not timely made by LL, the tenant may exercise the remedies within the LL/T Act, which typically involve breaking the lease.
